Do You Need an Odessa Burn Injury Lawyer?

A burn injury can occur in any number of ways, from oil field work to car accidents, or due to a hazardous property condition. Burns are caused by friction, heat, chemicals or electricity. Burns can also lead to complications, like infections, bone and joint problems.
Burn severity is generally measured by degrees:

  • First-Degree Burns: The outer layer of skin is affected, like a mild sunburn. Your skin may be red and painful, but there won’t be any blisters.
  • Second-Degree Burns: The skin’s outer layer and dermis (the layer underneath) have been damaged. Your skin will be bright red, swollen, and may look shiny and wet. There will be blisters and painful to the touch.
  • Third-Degree Burns: This level of burn destroys two full layers of your skin. It may look black, brown, white or yellow. It won’t hurt because of nerve damage caused by the burn.
  • Fourth-Degree Burns: The deepest and most severe burn, which may be life-threatening. All the layers of skin, as well as your bones, muscles, and tendons are damaged.

If a burn is minor, you should expect a quick recovery and be able to handle such an insurance claim yourself. If there is any significant effect on your life or serious complications, call our office.

Be careful when dealing with insurance companies after a burn injury in Odessa.

Some insurance adjusters will try to get you to agree to a quick settlement for fast cash that will probably be worth far less than what your case is worth. Because of our decades of trial experience, we know what it takes for a burn injury case to be successful. The insurance company also knows we’re serious about helping our clients and won’t do them any favors.

The Kemmy Law Firm takes our commitment to our clients seriously. We emphasize quality service over having more clients than we can handle, which wouldn’t do anyone any good. We treat our clients so they feel they’re the only ones we have.

Many Types of Accidents Can Result in Burn Injuries

The Kemmy Law Firm has decades of combined experience working with injured clients, including those with burn injuries. We’re able to litigate all kinds of burn injury cases, caused by a wide range of accidents. Often burns are caused by auto accidents where there can be multiple injuries, including those of the spine, head, neck, and back. Burns may also be caused in house fires or chemical or electrical exposure at work.

Serious burns caused in the workplace or while performing your job should be covered by workers’ compensation. If a third party, such as a contractor, building owner or manager, acted negligently in causing the injury, a separate burn injury lawsuit could be filed against the responsible party.

If you’ve suffered significant burns in any of these types of accidents, retain experienced legal representation by local accident attorneys who not only know about insurance, Texas law, and litigation but the medical and psychological issues that can come with a severe burn. The Kemmy Firm not only helps you obtain fair compensation, but we’re here to help get your life back on track.

How Are Burn Injuries Treated?

After initial first aid, if you have a severe burn you may receive water-based treatments (ultrasound mist therapy to clean and stimulate the wound tissue), fluids to prevent dehydration, pain and anxiety medications, burn creams and ointments, specialty wound dressings and drugs to prevent or treat infections.

Depending on the location of the burn, you may need help breathing, use a feeding tube, have incisions made to large burn scabs, get skin grafts (a surgical procedure where sections of healthy skin are used to replace the scar tissue caused by deep burns) and plastic surgery to improve the appearance of burn scars and increase the flexibility of joints affected by scarring.

Part of the treatment may be the use of hyperbaric oxygen (HBO) in a hyperbaric chamber. Given within the first 48 to 72 hours of a burn injury, HBO therapy increases the oxygen saturation in the body, which speeds up the recovery process.

Our Odessa Burn Injury Attorneys Will Determine Liability

The Kemmy Law Firm, through our investigation, will make a determination as to who may be held legally responsible for your injuries. Evidence can include the incident/police report, security video footage, witnesses accounts, an examination of damaged equipment and the findings of engineers and accident reconstructionists.

We will communicate with the parties involved, their attorney or insurance company. They may deny responsibility, but after we supply the evidence we’ve found and reports from our experts, we often successfully negotiate settlements.

Compensation in Burn Injury Cases

Recovering from serious burns depends on their severity and potential complications. Recovery may mean regaining, much, if not all, of your function. There may also be substantial scarring that you’ll have to live with long after your treatment.

Burn recovery is notorious for being a long, painful process. The total costs could be in the hundreds of thousands of dollars, perhaps over a million, depending on the circumstances. Through an insurance claim or lawsuit, a Odessa burn injury lawyer will fight for you to receive compensation for your:

  • Out of Pocket Expenses
  • Past and Future Medical Bills
  • Lost Wages and Employment Benefits
  • Past and Future Pain and Suffering
  • Past and Future Mental Anguish
  • Disfigurement
  • Physical Limitation
  • Reduced Earning Capacity
  • Loss of Consortium

Our Process for Pursuing Your Odessa Burn Injury Claim

After we discuss your burn injury accident, if we’re retained, we will start an investigation into what happened, why, and who should be held accountable. Then, we will contact the responsible parties, who normally put us in contact with their attorney or insurance company.

The vast majority of serious burn cases settle, either before a lawsuit is filed or afterward. Insurance companies won’t take an attorney seriously if they’re not known to be ready to go to trial. We have a deep understanding of Texas law, work with medical experts, and know how juries respond.

We are aggressive and strategic negotiators. If an insurance company refuses to offer what’s right, they know we will take your case to trial.

Generally, with rare exceptions, the time limit, or statute of limitations, to file a personal injury lawsuit under Texas law is two years. You should contact us well before that deadline approaches so we can protect your rights and start our investigation before evidence is lost and witnesses’ memories fade.

We Take Burn Injury Cases to Trial and Win

Trial preparation in burn injury cases is critical to obtaining the best possible outcome. Having command of the facts and law makes it easier to be successful because it shows the insurance company they cannot get away with offering less than what you deserve.

Insurance companies normally offer less to settle cases early when many of the facts are unknown, but due to the discovery portion of the litigation process, both parties normally find critical information. Both sides, then ask each other questions, exchange documents, and share information. Once the true value is determined, we will make sure you recover a fair and equitable amount to help you in the long run.

Over the years we have developed an impressive record of verdicts and settlements. If insurance companies won’t cooperate and refuse to offer fair compensation – we have the skill and resources to bring any case to trial – and win.
