COVID-19: Court Closures & Legal Info in the Permian Basin

COVID-19 has impacted the lives of many throughout the Permian Basin, Texas, and New Mexico. As the situation continues to evolve, The Kemmy Law Firm wants to reassure our clients and the communities that we serve that we are taking this situation seriously, and putting safety measures in place that prioritize the health and well-being of our clients and staff. As a firm, we are carefully monitoring and adhering to the Centers for Disease Control and Prevention (CDC), Texas Department of State Health Services, New Mexico Department of Health, other government agency guidance, and staying abreast of any changes or updates.

Attorney Tom Kemmy, our family of lawyers, and our staff have all been advised on the practical measures to help stem the tide of COVID-19, including regular hand washing, the use of hand sanitizer, frequently disinfecting commonly touched areas, and social distancing whenever possible. This involves using video and phone conferences and communicating via phone and e-mail to limit in-person interaction.

Medical Care During this Time

Social distancing can be challenging and it can be hard to know what appointments to keep. While it is always important to get medical treatment after a personal injury accident, we want to stress the importance of continued care at this time.

The medical profession is expected to be under tremendous pressure in the coming weeks. Professionals and hospitals treating COVID patients may need all available medical masks and robes. So we anticipate that some therapy, pain management, and other medical practices that our clients rely on may scale back their hours or close temporarily.

We encourage you to speak with your providers early on and discuss what you can do at home to treat injury symptoms in the event you cannot get in to see your doctor. We also encourage you to continue documenting your injuries at home. Keep a diary of your pain and impairment – as well as what you are doing to treat your injuries.

Texas Court Closures

Most courts in Texas, including those in which we practice, have cancelled jury trial settings for the next month and reduced its docket only to specific, essential court hearings only. We anticipate that this will continue longer than a month, possibly into the summer. The Supreme Court of Texas has asked that courts and all litigants consider extensions of deadlines in all cases.

New Mexico Court Closures

The District of New Mexico postponed all civil and criminal jury trials set to begin on or before April 10 until further notice. The newly imposed measures and precautions can be reviewed here.
