COVID-19: Court Closures & Legal Info in the Permian Basin

Posted by: Kemmy Law Firm

COVID-19 has impacted the lives of many throughout the Permian Basin, Texas, and New Mexico. As the situation continues to evolve, The Kemmy Law Firm wants to reassure our clients and the communities that we serve that we are taking this situation seriously, and putting safety measures in place that prioritize the health and well-being of our clients and staff. We also want to ensure you get the answers and consummate legal guidance you expect.

As a firm, we are carefully monitoring and adhering to the Centers for Disease Control and Prevention (CDC), Texas Department of State Health Services, New Mexico Department of Health, other government agency guidance, and staying abreast of any changes or updates.

Attorney Tom Kemmy, our family of lawyers, and our staff have all been advised on the practical measures to help stem the tide of COVID-19, including regular hand washing, the use of hand sanitizer, frequently disinfecting commonly touched areas, and social distancing whenever possible. This involves using video and phone conferences and communicating via phone and e-mail to limit in-person interaction.

If you are an existing client and have a question about your case in light of the COVID 19 pandemic or you believe that you were mistreated or harmed while seeking medical care, please call (210) 735-2233 or send us an email at [email protected]. We are available and will be in touch as soon as possible.

We’re Available to You & Working

Our attorneys and staff are currently working to address your needs and questions.

Currently, we will have at least one attorney and one staff member in the office during regular business hours to speak with clients by phone. The rest of our team is operating remotely, currently in contact with opposing counsel, and working to move cases towards successful resolution.

We understand the position you may be in without a timely resolution to your personal injury claim. Our team sympathies with this unfortunate delay, and we are committed to helping you find a solution.

Even though courts are drastically reducing hours, we will continue working on your case to the fullest extent possible. We are preparing to use teleconferencing to conduct depositions, mediations, and even court hearings. We believe that cases will continue to settle during this period. We will stay in touch with defense lawyers and insurance adjusters on your case – whether we are working at the office or working remotely.

We’ll Keep You Informed

We are closely monitoring all client deadlines, court closures, and will continue to keep you updated.

If the situation continues to progress, we will explore all available options to provide you with the best possible representation. This may include using video depositions, testimony, and e-document submission, and other tools and technologies should the need arise.

Medical Care During this Time

Social distancing can be challenging and it can be hard to know what appointments to keep. While it is always important to get medical treatment after a personal injury accident, we want to stress the importance of continued care at this time.

The medical profession is expected to be under tremendous pressure in the coming weeks. Professionals and hospitals treating COVID patients may need all available medical masks and robes. So we anticipate that some therapy, pain management, and other medical practices that our clients rely on may scale back their hours or close temporarily.

We encourage you to speak with your providers early on and discuss what you can do at home to treat injury symptoms in the event you cannot get in to see your doctor. We also encourage you to continue documenting your injuries at home. Keep a diary of your pain and impairment – as well as what you are doing to treat your injuries.

Texas Court Closures

Most courts in Texas, including those in which we practice, have cancelled jury trial settings for the next month and reduced its docket only to specific, essential court hearings only. We anticipate that this will continue longer than a month, possibly into the summer. The Supreme Court of Texas has asked that courts and all litigants consider extensions of deadlines in all cases.

New Mexico Court Closures

The District of New Mexico postponed all civil and criminal jury trials set to begin on or before April 10 until further notice. The newly imposed measures and precautions can be reviewed here.

If you have legal proceedings scheduled in Hobbs New Mexico, Odessa Texas, San Antonio, or anywhere in the Permian Basin region, reach out to Kemmy Law Firm to discuss how these closures affect you.

You Can Always Reach Us

Your case and the dedicated service the Kemmy Law Firm provides will not be impacted despite this uniquely challenging time. We appreciate your patience and we will continue to bring you updates.

We of course share our clients’ concerns about the health and financial security of their families during the days and weeks ahead. That is why we will continue to aggressively move cases toward resolution – even if we have to use Skype and teleconferencing to do so. Your case remains just as important to us now as it did before this crisis began.

We’re confident that our firm’s standards of hard work and open communication will see us through this together. In the meantime, please stay safe and follow the guidance of public health professionals.

Our lawyers and staff are available at (210) 735-2233.

We’re All In this Together

We truly appreciate your choice in deciding to work with an attorney who will stand by you and fight for you no matter what.
