Record Verdict for Severely Injured Elderly Man

Tom and Danny Kemmy secured the verdict after a two-week trial. Our client was admitted to Regent Care, a skilled nursing facility, on November 26, 2013, to receive care for a groin rash that was preventing his hip surgery. He left Regent Care on December 9, 2013, suffering from permanent paraplegia and permanent incontinence. We alleged, and the jury found, Regent Care’s nurses were negligent in failing to promptly notify the treating physicians of a significant change in his condition, resulting in delay in diagnosing and treating a spinal tumor that ultimately caused the client to suffer permanent paralysis and incontinence. The jury held Regent Care responsible and awarded over $13.5 million in damages.

The verdict was reduced by prior settlement credits and the Damage Cap for medical cases, resulting in a recovery of $5,000,000. Attorney fees were $2 million. Expenses for the case were $165,000.
