      Texas follows the comparative negligence rule, meaning plaintiffs can still recover damages even if they bear partial fault for the accident. However, this only applies if you bear less than 51% of the fault. Also known as the 51% rule, comparative negligence bars plaintiffs from seeking compensation if their percentage of fault is greater than the percentage that isn't.
