When Car Accidents Are Caused by Road Rage

Posted by: Kemmy Law Firm

An accident because of a mistake is scary enough. Someone may have been driving too fast, or a distracted driver could have rear-ended you. But if another driver uses their vehicle as a weapon to threaten or injure you, it’s far more traumatic. If another driver injures you in a road rage incident, the Kemmy Law Firm could help you get the compensation you deserve.

It seems like we, as a society, are angrier and more willing to lash out at strangers on the road than ever. In Texas, for example, road rage accidents happen far more than they should:

  • In Dallas, a woman was hit by a car during a road rage incident along Interstate 35E in November. The victim left her vehicle to confront the driver, who then backed up, accelerated, hit her, and left the scene, according to NBCDFW
  • According to police, a 64-year-old suffered a severe leg injury after being hit in a road rage incident in San Antonio in November. He then yelled at an SUV driver, who turned around and hit him with his vehicle as he stood outside his car, KSAT reported

Road Rage Insurance Issues

Insurance generally covers accidents caused by mistakes and negligence, not intentional acts. If someone intentionally strikes your vehicle because of road rage, their insurance may not cover the incident. The same applies to you if you’re the aggressor. You also may not be covered if you strike someone after they started the problem.

Your vehicle insurance may cover your claim if you have Personal Injury Protection (PIP) or Uninsured/Under-Insured motorist coverage (UM/UIM) and you didn’t commit the act. They’re not part of the minimum coverage required by state law.

It’s a good idea to get this coverage at the highest amount you can afford. It not only covers instances of an intentional road rage situation, but when the other driver has little or no insurance, or you’re the victim of a hit and run accident, you might need the most coverage.

Do Your Part To Avoid a Road Rage Incident

You may be innocent and become a victim. You didn’t do anything wrong, but for whatever reason, the other driver becomes upset. They drive aggressively, threaten you, and may intentionally hit your vehicle.

Often these incidents start when one driver does something dangerous or thoughtless then the other driver retaliates. They may chase after the other vehicle, yell at the driver, or drive in a way that endangers the other person.

If someone angers you because of their terrible, maybe even dangerous, driving, the best thing you can do is let it go, as hard as that may be. Speeding up to yell at the possibly intoxicated or armed driver is not worth it. You’re in a no-win situation. If you or a passenger can safely report the driver to the police, do so. If your passenger can make a video of what’s going on while you’re at a safe distance, that could help the police as well.
